Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF)
What buyers, sellers, landlords and tenants can expect when working with us
From 1 July 2026, real estate agents across Australia are required to comply with new Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) laws.
These reforms, often referred to as "Tranche 2," bring real estate into the same regulatory framework that has long applied to banks and financial institutions.
1. What is AML/CTF
AML/CTF means Anti-Money Laundering and Counter-Terrorism Financing. These requirements help ensure property transactions are conducted safely, transparently and in accordance with Australian law.
2. Why is Halyn Property requesting this information?
Like all real estate agencies across Australia, Halyn Property is required to comply with AML/CTF obligations when providing regulated services. We are committed to making this process as seamless as possible, with a focus on transparency, clear communication and the secure handling of your information.
3. What is Customer Due Diligence
Customer Due Diligence is the process of verifying your identity and collecting relevant information to help Halyn Property meet its AML/CTF obligations and ensure transactions are conducted lawfully and securely.
4. What information may be requested?
Depending on the ownership structure and the nature of the transaction, your Halyn Property representative, or the AML provider, may request information or evidence relating to the following:
- Your full name, date of birth, occupation, and residential address
- Details from an identification document to verify your identity (such as a driver's licence or passport)
- Ownership or control information for a legal entity (evidence of beneficial ownership)
- Information that helps us understand the nature and purpose of the transaction and, where required, the source of funds or wealth
5. How will this information be used?
All information gathered is used by Halyn Property solely to meet our legal obligations under the AML/CTF Act. This includes verifying identity, assessing risk, and maintaining required compliance records. Where required by law, it may also be used to support reporting obligations to AUSTRAC. This information is held securely and kept confidential.
6. What happens if we do not receive required information?
If the requested identification or supporting documents are not provided, we may be unable to proceed with the service until the information is received. Completing customer due diligence is required by law before certain real estate services can be provided.
